Florida Stormwater Inspection & Maintenance Requirements:
Florida’s updated statewide stormwater rule raises the importance of long-term inspection, maintenance, and documentation for ERP-permitted stormwater systems. The rule was approved unanimously by the Legislature, passing the Senate 37–0 on February 22, 2024 and the House 114–0 on March 5, 2024. It became effective on June 28, 2024.
Under the updated rule, inspection frequencies vary by system type. These schedules help owners, property managers, HOAs, and public agencies plan recurring O&M, maintenance budgeting, recordkeeping, and corrective action. For permits issued after June 28, 2024, required inspections conducted after June 28, 2025 must be performed by a Qualified Inspector.
Failure to follow the required inspection and maintenance obligations can create compliance exposure. If a stormwater system fails or deviates from the permit, the responsible entity must submit a report to the agency within 30 days describing the remedial actions taken. The state, water management district, or delegated local government may enforce violations by requiring corrective action, seeking injunctions, recovering costs, and pursuing civil penalties of up to $15,000 per offense, with each day of a continuing violation treated as a separate offense.
For owners and managers, the practical takeaway is simple: stormwater inspection and maintenance should be treated as a recurring compliance program, not a one-time task. Keeping clear records, completing inspections on schedule, and addressing deficiencies early can help reduce risk and prevent small maintenance issues from becoming larger failures.
